    BritCham Comments on Draft Customs Decision
    The Department of Customs summited a draft Decision to replace Decision 23/2019/QĐ-TTg on the list of imported goods subject to customs procedures at the port of entry, including wines and tobacco. BritCham has prepared draft comments highlighting practical issues for UK–Vietnam trade, with recommendations on scope, definitions, facilitation for compliant traders, review mechanisms, and alignment with FTA commitments.

    BritCham Submits Feedback on Draft Amendments to the Advertising Decree
    BritCham has submitted a follow-up letter to the Ministry of Culture, Sports and Tourism on the Draft Decree guiding the Law on Advertising. While welcoming efforts to align with Resolution No. 68-NQ/TW on private sector development, the letter raised concerns over monitoring responsibilities, recommending that advertising service providers and publishers, not advertisers, be accountable for content oversight, except where advertisers place ads directly.

    Update on Draft Cybersecurity Law
    The Ministry of Public Security (MPS) has circulated an updated draft of the Cybersecurity Law, submitted to the Ministry of Justice on 8th August for appraisal. Key highlights include the removal of data localisation requirements in favour of cross-border transfer rules aligned with the Data Law and PDP Law; concerns over broad government access to user data via informal requests; a 24-hour content takedown requirement viewed as unworkable; and strong opposition to provisions that could allow “backdoor” access to company systems. Financial institutions have also flagged potential overlaps with SBV regulations, calling for greater alignment.

    Update on Work Permit Regulations
    On 7 August 2025, the Government issued Decree No. 219/2025/ND-CP, introducing significant changes for foreigners working in Vietnam by integrating the demand-reporting process into work permit applications. BritCham circulated the invitation to the VBF virtual briefing held on 13 August, which provided detailed insights into the decree and its practical implications. Building on this, BritCham is working with DBT to plan a follow-up session in early October, linking the discussion to labour mobility under the CPTPP framework.

    LEGAL UPDATES

    Vietnam formally introduced Beneficial Ownership (UBO) regulations on July 1, 2025aimed at enhancing corporate transparency and aligning with international anti–money laundering standards. While these rules bring new compliance obligations for businesses, they are vital for strengthening investor confidence and combating illicit financial activities.
    Vietnam is on a strong growth trajectory, with an evolving legal landscape and deeper integration into the global economy. However, foreign investors must navigate and comply with complex regulations, especially recent changes and emerging trends in areas such as personal data protection, corporate law, and taxation. Seeking professional legal advice is essential to ensure effective operations and compliance in Vietnam.
