- Vietnam’s Decree No. 274/2026/ND-CP, effective from 21 August 2026, introduces a more streamlined framework for selecting investors for business investment projects. For foreign investors, the Decree is particularly relevant to projects involving land or sectors where investor selection through bidding is required. It clarifies the circumstances in which bidding applies, sets out more detailed procedures and evaluation criteria, and addresses the treatment of projects already underway. The new framework may provide greater clarity and predictability for foreign investors assessing investment opportunities in Vietnam, particularly where projects involve land access or competitive investor selection. Investors considering new projects should assess the applicable investor selection requirements at an early stage and factor the revised procedures and evaluation criteria into their investment planning and bidding strategy.
- Vietnam’s Draft Law on Data Security
- Vietnam’s proposed Law on Data Security would introduce a broader, risk-based framework governing data throughout its life cycle, with significant implications for foreign investors and multinational businesses. The Draft Law would apply not only to personal data but to data generally, potentially covering foreign entities connected with data-processing activities in Vietnam. Businesses may face new requirements for data classification, data inventories, security assessments, third-party oversight and incident reporting. Stricter requirements would apply to Important Data and Core Data, including enhanced security standards, controls on cross-border transfers and, for certain categories, data localisation in Vietnam. The Draft Law also introduces specific obligations for businesses using cloud, AI and other technology services. It is proposed to take effect on 1 December 2027, subject to legislative changes.
