REQUEST FOR INPUT ON AMENDMENTS TO THE LAW ON INVESTMENT & DECREE 31

Dear members

We have just received the enclosed official request from the Ministry of Finance (MOF) regarding the amendment to the Law on Investment (LOI) and Decree 31/2021/ND-CP. This initiative aims to further refine Vietnam’s investment legal framework in alignment with the Politburo’s Resolution 68 on private sector development and Resolution 66 on legislative reform to support economic development in a new era.

Accordingly, MOF Legal Department would appreciate your recommendations for amending & supplementing the following areas:

• LOI;
• Decree 31/2021/ND-CP;
• List of locations eligible for investment incentives; Và
• List of sectors/ businesses eligible for investment incentives.

Your inputs should be made in Vietnamese, following the MOF enclosed Template, and sent to Duyen Nguyen at duyen.nguyen@britchamvn.com by COB Tuesday, 27^th Có thể for consolidation and submission.

For your reference and consideration, we also enclose the list of VBF issues previously submitted to MPI in March 2024, in case you wish to reflect on them again in your feedback.
